By accessing or using Modaic ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Modaic is an AI-powered fashion photography platform that allows users to upload product images and generate professional on-model visuals using artificial intelligence. You acknowledge that AI-generated results may vary and that outputs are not guaranteed to meet any specific standard of quality or accuracy.

3. Eligibility

You must be at least 18 years of age to use the Service. By using Modaic, you represent and warrant that you meet this requirement.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. User Content & Rights

You retain ownership of all images and content you upload to Modaic. By uploading content, you grant Modaic a non-exclusive, worldwide, royalty-free licence to use your content solely for the purpose of providing the Service to you. You are solely responsible for ensuring that your uploaded content does not infringe any third-party intellectual property rights.

You own all AI-generated images produced from your uploads. You may use them for personal and commercial purposes in accordance with these terms.

6. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, offensive, or that infringes third-party rights
• Generate images of real individuals without their explicit consent
• Attempt to reverse engineer, copy, or exploit any part of the platform
• Use automated tools to access the Service in an unauthorised manner
• Resell, sublicense, or redistribute the Service without written permission

7. Subscriptions & Payments

Modaic offers subscription plans billed on a recurring monthly basis. All fees are charged in Indian Rupees (INR) and are processed through a third-party payment provider. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

Credits are allocated at the start of each billing cycle. Unused credits roll over each month as long as your subscription remains active. Credits are non-transferable and have no monetary value.

All payments are non-refundable except as required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

8. Intellectual Property

All platform content, design, trademarks, and technology comprising the Modaic Service are owned by or licensed to Modaic and are protected by applicable intellectual property laws. Nothing in these terms grants you any right to use our name, logo, or branding without prior written consent.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated outputs will meet your expectations.

To the maximum extent permitted by law, Modaic shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These terms are governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of India.
